Time Limits for Making a Road Accident Claim
Strict time limits apply for lodging motor vehicle accident claims in NSW. Acting promptly is crucial to preserve your rights. Key
deadlines include:
- Within 28 days: You should report the accident and lodge a claim form (Application for Personal Injury Benefits) with the CTP insurer within 28 days of the accident to be eligible for back payment of lost wages.
- Within 3 months: You must lodge your claim form within three months of the date of the accident. Even if you miss the 28-day window, lodging within 3 months may still allow you to claim ongoing treatment costs and partial wage replacement.
- Common law claims: If you are eligible to make a common law claim for lump sum damages (such as for permanent impairment or past and future loss of income), proceedings generally must be commenced within 3 years of the date of the accident.
- Extensions: In some cases, claims lodged outside the standard time limits may still proceed if you provide a full and satisfactory explanation for the delay. However, it is always best to seek legal advice as early as possible to avoid complications.
